Hire Agreement - Terms & Conditions
The Hirer shall be defined as Lakeys Bikes ltd for the purpose of this agreement. The Client shall be defined as the person who is hiring the bike.
PLEASE DO NOT CYCLE ON THE BEACH! £20 CLEANING FEE WILL BE CHARGED
On Collection
Proof of identification must be provided upon collection of your equipment and must include a photo ID e.g. driving licence or passport.
I, the Client, understand that I am responsible for all equipment relating to this agreement. I confirm that I will be responsible for the payment of any damage (including third party) caused as a consequence of any dangerous cycling, loss of control, negligence. Bicycles and equipment hired on a rental agreement remain the property of Lakeys bikes. The Client is obliged to take good care of the bicycle(s) and equipment hired and to take all reasonable precautions to protect them from damage, loss or theft.
The Client is responsible for immediately informing Lakeys bikes of any damage or loss sustained to or from the bicycle or equipment during the period of hire. This is particularly important in the case of damage likely to affect the safety of the cycle or equipment.
Should any damage be sustained to the bicycle, components or equipment during the hire period, the Client is responsible for the full replacement cost at current market price of the whole or part of the items so damaged. In selecting to confirm the reservation and signing this agreement the Client is accepting that any damage found to the bicycle after return will be charged.
Important: all bicycles will be provided with a lock and the Client is responsible for ensuring that the frame and front wheel are adequately secured to a solid object from which the lock cannot be removed when left unattended. The Client will be responsible for the full replacement cost of the bicycle, part thereof or any of our equipment, at current market price, if it is lost or stolen during the period of hire.
Competents
I, the Client, confirm I am a competent cyclist. I recognise I will be riding bicycles which I may not be familiar with and as such I will exercise appropriate care and attention. Safe cycling is dependent on alertness and good judgement. Please cycle sensibly with respect for others and those around you. Cyclists are expected to follow the Highway Code and any other cycling code applicable. Cycling can be dangerous and has risks involved. By signing this Agreement you declare that you are in good health and not suffering from any medical condition or disability which is likely to adversely affect normal control of the bicycle.
The Client also agrees not to undertake any manoeuvres which are beyond their level of skill or beyond the design purposes of the equipment provided by the Hirer. Not to ride on pavements or footpaths and to keep to the designated cycle routes or areas where it is legally permissible to cycle. The Client acknowledges and agrees that the cycle is in good condition in all respects and undertakes not to misuse it, and to return it with all accessories in the same condition as when received (ordinary wear and tear excepted) to the place and on the due date and time specified on the hire agreement as signed by the Client.
Mechanical failure
I, the Client, understand that in the event of a mechanical failure, I am to return the cycle the same day (or as soon as possible) to the Hirer who will replace the cycle (whenever possible). I understand that in the event of a mechanical failure, the Hirer will offer a
breakdown service during their opening hours of 0900 – 1700 for the cycle but not the individual Client. The emergency number is 07829 881889
Refunds
I, the Client, understand that refunds are only given per bike (not group) and only if the Hirer could not restore the journey or allow extra time to complete the ride. Refunds cannot be given for punctured tyres or damage caused to gears as a result of incorrect use. I agree that I may have to accept responsibility for bike damage caused by incorrect use of equipment.
I acknowledge the strong recommendation of the Hirer to use safety helmets. By signing this form, the Client assumes full responsibility for any accident, injury or death which should occur as a result of their own decision to wilfully not wear helmets. All minors must wear a cycle helmet as a condition of hire, and will only be issued with equipment when accompanied by a parent or guardian over the age of 18.
Charges
I, the Client, confirm that I will be responsible for the payment of any surcharge levied as a result of the cycles being returned later than the agreed time stated on the booking system. If the bikes are returned after 1700 hours on the return date stated you will be liable to a £5 overnight surcharge per bike, if the bikes are returned after 9am the following day after your return date, you will be liable for an extra days hire charge as the bikes were then not able to be hired the following day due to your late return.
Claims
I, the Client, fully indemnify the Hirer against any and all claims of injury to myself or any third party, unless it can be proven that the Hirer did not fulfil reasonable maintenance procedures for the equipment being used.
The Client shall fully indemnify the Hirer in respect of all costs, claims, expenses, and demands, which it may suffer or incur and which arise directly, or indirectly, out of the use of the cycle during the period of hire.
The Client shall be solely responsible for and shall keep the Hirer fully indemnified in respect of all fines, impositions or other penalties occasioned by the use of the cycle during the period of hire in respect of violation of any legislation for the time being in force.
This Agreement is covered by Jersey Law. The Court of Jersey has exclusive jurisdiction to deal with any claims arising under this Agreement.
In the event that any part of the Agreement is for any reason unenforceable the remainder shall remain in full force and effect. The Hirer reserves the right to immediately terminate the hire and retain the charges should the hire conditions be broken.
Delivery Service:
Delivery and collection of hired cycles is £15 per booking delivery or collection or £25 for both. Alternatively, bikes can be collected from and delivered to Lakeys Bike Hire premises by arrangement. Bikes cannot be ordered for delivery on the same day as hire start date.
Important: Cycles will only be delivered to / handed over to the person named on the rental contract, upon production of the identification set out above.
Cancellation of a reservation by customer:
Cancellations up to 7 days prior to the first rental day: Full refund. Cancellations 7 days up to the first rental day: Option to reschedule booking free of charge, otherwise a refund of 50% of the amount paid. Same day cancellations, no refund. The cancellation period does not include the first rental day.
Definition of Day:
A day is defined as an 8 hour period generally commencing at 0900 and ceasing at 1700. These times may be varied by mutual agreement depending on the location of hire start / finish. Single day hires of over 8 hours are by agreement and may be subject to an extra charge.
Cancellation by Lakeys bikes ltd:
In the event of Lakeys Bikes ltd being unable to fulfil a pre-booked hire or part thereof every effort will be made to source replacement equipment or rearrange the hire for a different date. Should this not be possible a full refund will be given.
